Terms of Service

The terms that cover this website and the custom AI phone agents Voyqen builds for travel agencies. Outbound calling, recording, and AI-voice rules sit with your agency. We run the agents you hired us to run.

Last updated September 10, 2026

1. Agreement

These Terms of Service ("Terms") govern your use of voyqen.com and the custom AI phone-agent services Voyqen ("Voyqen", "we", "us") provides to travel agencies.

By using the site, submitting a form, or signing an order with us, you agree to these Terms. If you are accepting for an agency, you confirm you have authority to bind that agency. If you do not agree, do not use the site or the services.

Paid work is also governed by the order form, statement of work, or Data Processing Addendum we issue. If those documents conflict with these Terms, the order controls for fees, scope, and term; the DPA controls for personal data we process on your behalf; these Terms control for everything else.

Our Privacy Policy is incorporated by reference and explains how we handle personal information.

2. Definitions

In these Terms:

  • "Agency Content" means your name, offers, scripts, greetings, hours, brand voice, lists, CRM data, and traveler records you provide or that we write back to your systems.
  • "Agents" means the inbound and outbound AI phone agents we build and operate for you under an order.
  • "Services" means the Agents, related implementation, hosting, telephony configuration, CRM write-back, and ongoing operation described in your order.
  • "Traveler" means a person who calls your agency or whom you ask us to call, including leads, clients, and their traveling parties.
  • "Website" means voyqen.com and related marketing pages.

3. Eligibility and authority

The Website and Services are for businesses, not consumers. You represent that you are at least 18, that you can form a binding contract, and that you are not barred from receiving services under US or other applicable law.

You represent that you have the right to give us the phone numbers, lists, recordings disclosures, brand voice, and CRM access you ask us to use.

4. The website

The Website is for information and so you can get in touch. Features, examples, testimonials, and metrics on the site are illustrations and typical outcomes, not a warranty that your agency will see the same results.

Do not scrape, overload, probe, or attempt to break the site. Do not copy our content to train a competing model or to resell as your own. We may suspend access if we believe the site is being abused.

5. The services

Voyqen builds and operates custom inbound and outbound AI phone agents for travel agencies. We put those agents on numbers you authorize and, where agreed, connect them to your CRM, including Zoho CRM.

We are not a self-serve software platform. You do not receive a general right to build, clone, or resell agents. You receive the agents described in your order, hosted and maintained by us.

Inbound services answer calls on numbers you provide or that we provision for you. The agent greets, captures a trip brief, holds or routes as designed, transfers to an advisor when required, and logs the result.

Outbound services place calls to leads and contacts you supply, including instant callbacks when a new lead arrives in your CRM. The agent follows the script, hours, and transfer rules we agree with you.

CRM write-back, where included, writes agreed fields into Zoho CRM or another system you connect. We are not responsible for how that CRM stores, displays, or later changes those records, or for downtime of a CRM we do not operate.

We do not guarantee a booking rate, conversion rate, or volume of trips sold. Outcomes depend on your offers, your lists, your hours, how travelers respond, and carrier performance.

Agents use generated speech. They are not licensed travel advisors, insurers, or lawyers. You decide which calls should transfer to a person, and you remain responsible for advice given after transfer.

6. Orders, changes, and acceptance

An order or statement of work describes the agents, numbers, languages, CRM connections, hours, and fees. Work begins when both sides have agreed that document (including by email confirmation) and any kickoff materials we request are in.

Go-live means the agent is answering or placing calls on a production number. After go-live, material changes to scripts, hours, or integrations may be billed as additional work if they are outside the original order.

We may use subprocessors (telephony, hosting, speech, language, voice) to deliver the Services. We remain responsible for their work as it relates to the Services we provide you.

7. Your responsibilities

You give us accurate hours, greetings, offers, transfer rules, and CRM access needed to run the agents, and you keep that information current.

You own or have the right to use the phone numbers, recordings disclosures, brand voice, and customer lists you ask us to use. You will not send us lists you do not have the right to call.

You will not ask the agent to collect full payment card numbers on the call, to process protected health information unless we have a signed Business Associate Agreement, to give visa or medical advice, or to make promises your agency cannot keep.

You decide which calls should transfer to a person. You staff that transfer path during the hours you tell us it is available, or you accept that a traveler may be offered a callback instead.

You are responsible for configuring your CRM, for the accuracy of records you ask the agent to rely on, and for how your staff use recordings and transcripts we deliver.

8. Outbound calling, TCPA, and AI voice rules

This section is a core part of these Terms. You, not Voyqen, are the initiator of outbound calls placed for your agency. You are solely responsible for lawful outbound calling, including consent, do-not-call rules, time-of-day rules, caller identification, AI and recording disclosures, and any telemarketing or consumer-protection laws that apply to your agency.

Those laws include, without limitation, the Telephone Consumer Protection Act (TCPA) and FCC rules, the Telemarketing Sales Rule, the FTC Act, state telemarketing and do-not-call laws, and federal and state recording and eavesdropping laws. In February 2024 the FCC confirmed that AI-generated voices that resemble a human speaker are "artificial or prerecorded voice" under the TCPA. Calls that use our Agents are treated that way. Prior express consent (and prior express written consent for telemarketing) is required unless a statutory exception applies.

Without limiting the above, you represent, warrant, and covenant that:

  • You have obtained, and will maintain, all consents required before we dial, including prior express written consent where the law requires it for telemarketing or AI voice calls.
  • You will keep proof of that consent for at least five years, or longer if the law requires, and will produce it to us within five business days if we or a carrier, regulator, or court ask.
  • You will scrub lists against the National Do Not Call Registry, applicable state registries, and your own internal do-not-call list at the intervals the law requires, and in any case no less often than every 31 days, before those numbers are called.
  • You will not ask us to call numbers on a do-not-call list you maintain, emergency lines (including 911), hospital or healthcare emergency lines, patient rooms, or paging services.
  • Calls will only be placed during hours permitted at the called party’s location (typically 8:00 a.m. to 9:00 p.m. local time unless a stricter rule applies).
  • The agent will identify your agency as the party responsible for the call, will disclose that the caller is an AI agent where required (including at the start of the call where the law or a carrier requires it), and will offer an opt-out that you honor immediately.
  • You will not spoof or alter caller ID with intent to defraud, cause harm, or wrongfully obtain anything of value. Display names and numbers we transmit will be numbers you are authorized to use.
  • You will pass us opt-outs, revocations, and complaints the same day you receive them, and you will not recycle a number that has opted out.

We will not knowingly dial numbers you have marked as do-not-call in the data you provide, and we will stop a campaign if we reasonably believe it is unlawful. That operational help does not shift legal responsibility to Voyqen and is not legal advice.

We may audit, sample, or suspend outbound calling if a carrier, regulator, or our own monitoring indicates a consent, disclosure, or spam-flag problem. You will cooperate, including by pausing lists we flag.

You acknowledge that Voyqen is a service provider placing calls on your instructions. Indemnity for TCPA, TSR, do-not-call, and similar claims is in the indemnification section below.

9. Recordings and AI disclosure

Calls may be recorded and transcribed. Where the law requires notice, you will tell us the wording to use, or we will use a standard disclosure. You must not disable a required disclosure.

You are responsible for two-party or all-party consent rules in the jurisdictions you call into or receive calls from. If a state requires consent from every party before recording, you will obtain it or you will ask us in writing to disable recording for those calls, understanding that quality review and some CRM write-back may then be limited.

Recordings and transcripts are used to run the service, write to your CRM, and review quality with you. See our Privacy Policy for how long we keep them and for traveler requests.

10. Acceptable use

You will not use the Services, and you will not instruct an Agent, to:

  • Harass, defraud, phish, or spam; or place calls without a lawful basis.
  • Impersonate another business, clone a real person’s voice without that person’s authorization, or mislead a traveler about who is calling or that the speaker is AI where disclosure is required.
  • Collect payment card data, government ID, or protected health information except as expressly agreed in writing.
  • Interfere with carriers, our infrastructure, or another customer’s agents; probe or reverse engineer the Services; or extract voice samples, prompts, or outputs to train a competing model.
  • Resell, white-label, or run the Agents for a different business without our written consent.
  • Use the Services in a way that would make Voyqen a common carrier, an emergency dispatch service, or a provider of 911.

We may suspend an agent immediately if we reasonably believe it is being used unlawfully or is harming travelers, carriers, or our infrastructure. We will tell you as soon as we can. Repeated or serious violations are a material breach.

11. Fees and payment

Fees, usage, and payment timing are set in your order. Invoices are due as stated there. Late amounts may accrue interest at the lower of 1.5% per month or the maximum the law allows, and we may suspend agents for invoices more than 15 days past due after notice.

Unless the order says otherwise, implementation fees are earned as work is performed, and monthly or usage fees are non-refundable once an agent is live on a production number.

You are responsible for taxes that apply to the fees, other than taxes on our income. If a carrier, regulator, or CRM provider charges pass-through fees related to your numbers or usage, those are yours unless the order says we absorb them.

Quotes on the Website are invitations to talk, not offers. Pricing depends on inbound versus outbound, number of lines, languages, and CRM work.

12. Intellectual property

Voyqen owns the underlying agent technology, prompts, tooling, models we supply, know-how, and the look of the Website. You own Agency Content: your name, offers, CRM data, and traveler records.

For the term of the engagement we grant you a non-exclusive, non-transferable right to use the Agents we build for your internal travel-agency operations. You may not resell the Agents, sublicense them, or use them for a different business without our written consent.

You grant us a limited license to host, process, transcribe, and display Agency Content solely to provide the Services, including sharing it with subprocessors who need it to complete a call or a CRM write-back.

Voice outputs, transcripts, and summaries generated for your account are licensed to you for your internal operations. You have no exclusivity in phrasing or flows that we also use for other agencies. We do not claim ownership of the facts in a traveler’s trip.

We may use anonymized, aggregated learnings to improve our work. We will not use your traveler audio to train models for other customers unless you agree in writing.

If you send feedback, you assign us the right to use it without restriction or payment. You grant us a revocable right to name your agency as a customer on the Website. Send a written opt-out if you do not want that, and we will stop new uses.

13. Confidentiality

Each side will keep the other’s confidential information private and use it only to perform these Terms. That includes scripts, pricing, recordings, CRM credentials, and non-public business information.

This does not apply to information that is public, already known without duty, independently developed, or required to be disclosed by law (with notice if legally allowed). Recordings and traveler data are confidential to you and will be handled as described in the Privacy Policy.

14. Data processing

For traveler and call information, you are the controller and Voyqen is the processor. We process that information only to provide the Services, on your instructions in the order, these Terms, and any DPA.

You warrant that you have a lawful basis to collect and share traveler information with us, including for recording, transcription, CRM storage, and outbound calling, and that you will handle traveler rights requests. We will assist with those requests for data we still hold.

On written request after an order ends, we will delete or return recordings and transcripts we hold, except copies we must keep for law, disputes, or backups that rotate out on a normal cycle. CRM records already written to your systems stay in your CRM.

15. Carriers, CRMs, and other third parties

Telephony networks, carriers, and CRMs are outside our full control. A failed, dropped, or delayed call, a blocked caller ID, or a CRM API outage is not a breach by Voyqen if we configured the Agent as agreed.

If you bring your own numbers, trunks, or CRM credentials, your contract with that provider governs that provider. We are not their agent.

16. Security

We will use commercially reasonable administrative, technical, and physical safeguards designed to protect Agency Content, including access controls, encryption in transit, and least-privilege access to recordings and CRM credentials.

You are responsible for who at your agency can hear recordings, for rotating credentials we are given, and for notifying us promptly of suspected unauthorized access.

17. Warranties and disclaimers

We will provide the Services in a professional manner consistent with the order. We will use commercially reasonable efforts to keep production agents available, excluding scheduled maintenance, carrier failures, CRM outages, and events beyond our reasonable control.

THE WEBSITE AND SERVICES ARE OTHERWISE PROVIDED AS AVAILABLE. EXCEPT FOR THE WARRANTY IN THE PREVIOUS PARAGRAPH, VOYQEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.

We do not warrant that every call will connect, that every traveler will book, that a carrier will always complete a call, that generated speech will be error-free, or that a CRM will always accept a write-back. You remain responsible for verifying critical trip details before you charge a traveler or issue travel documents.

Some places do not allow implied warranty limits. Those limits apply only to the extent the law allows.

18. Not for emergencies or high-risk use

The Services are not a 911 or emergency service, not medical advice, and not a substitute for a licensed advisor on complex itineraries, visas, or insurance. Do not use the Agents where a failure could cause death, personal injury, or serious physical or environmental damage.

19. Limitation of liability

NEITHER SIDE IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR LOST-PROFIT DAMAGES, OR FOR LOSS OF DATA, GOODWILL, OR BUSINESS, EVEN IF ADVISED THEY WERE POSSIBLE.

VOYQEN’S TOTAL LIABILITY UNDER THESE TERMS IS LIMITED TO THE FEES YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM. IF YOU HAVE NOT PAID FEES, THE CAP IS ONE HUNDRED US DOLLARS. THAT CAP DOES NOT APPLY TO OUR FRAUD OR WILLFUL MISCONDUCT, OR TO LIABILITY THE LAW DOES NOT ALLOW US TO LIMIT.

The cap does not limit your payment obligations, your indemnities, or either side’s liability for breach of confidentiality or misuse of the other side’s intellectual property, except that our confidentiality liability for traveler data is still subject to the cap unless caused by our willful misconduct.

These limits are a basis of the bargain and apply even if a remedy fails of its essential purpose.

20. Indemnification

You will defend and indemnify Voyqen and our personnel against claims, damages, fines, and reasonable legal fees arising from your lists, your calling practices, your scripts and offers, your CRM data, your failure to obtain consent or give required disclosures, your use of the Agents in violation of these Terms, or a traveler’s claim about a trip you sold, except to the extent caused by our negligence or willful misconduct. This includes TCPA, TSR, do-not-call, recording-consent, and similar claims.

We will defend and indemnify you against claims that the unmodified agent technology we provide infringes a third party’s intellectual property, excluding claims based on Agency Content, your lists, your combination of the Services with something we did not supply, or use after we told you to stop. If infringement is alleged, we may modify the Agents, obtain a license, or end the affected order and refund prepaid unused fees for that portion. That is your exclusive remedy for infringement.

The indemnifying party must have prompt notice, sole control of the defense (except that we may participate with our own counsel at our cost), and reasonable cooperation. Neither side will settle a claim that admits fault by the other or imposes a non-monetary obligation on the other without prior written consent, not to be unreasonably withheld.

21. Term, suspension, and end of service

These Terms start when you first use the Website or sign an order, and continue until all orders end.

Either side may end an order for a material breach that is not cured within 15 days of notice, or immediately if the other side becomes insolvent. We may suspend or end Services immediately for unlawful use, non-payment after notice, or a carrier demand.

You may end an order for convenience as the order allows. If the order is silent, monthly services may be ended with 30 days’ written notice, and prepaid implementation is not refunded after work has started.

When an order ends we will stop the Agents. At your written request within 30 days we will delete or return recordings and transcripts we hold, except copies we must keep for law, disputes, or backups that rotate out on a normal cycle. Sections that should survive (fees owed, IP, confidentiality, data deletion, liability, indemnity, privacy) remain in effect.

22. Changes to these Terms

We may update these Terms for the Website by posting a new version and changing the date at the top. Material changes to a paid engagement will be agreed in writing or issued with at least 30 days’ notice to the email on your account. If you do not agree to a material change to a paid engagement, you may end the affected order before it takes effect; continued use after the effective date is acceptance.

23. Export and sanctions

You represent that you are not located in a comprehensively sanctioned jurisdiction and are not a prohibited party under US export or sanctions laws. You will not use the Services in violation of those laws.

24. General

These Terms are the whole agreement for the Website and, together with your order and any DPA, for the Services. Neither side is an agent, partner, or joint venturer of the other. Travelers are not third-party beneficiaries.

If a court finds a section unenforceable, the rest remains. We may assign these Terms in connection with a merger or sale of the business. You may not assign without our consent, except to a successor of your agency that assumes the order in writing.

Failure to enforce a right is not a waiver. Notices to Voyqen go to Michael@voyqen.com. Notices to you go to the email on your account.

Neither side is liable for delay or failure caused by events beyond reasonable control, including carrier outages, labor disputes, internet failures, and natural disasters, provided the affected side gives prompt notice and works to resume.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, unless your order names a different governing law. State and federal courts in Delaware have exclusive jurisdiction, except that either side may seek injunctive relief where the harm occurs, and except that an order may specify arbitration. EACH SIDE WAIVES A JURY TRIAL TO THE EXTENT THE LAW ALLOWS. Claims must be brought individually, not as a class or representative action, to the extent the law allows.
